RDC Indemnity Claim Forms (ELECTRONIC)

The Regulation CC amendments effective July 1, 2018 include a new RDC Duplicate Indemnity which allow a Depositary Bank holding a paper check to file an indemnity claim against the financial institution that took in the same item for deposit by Remote Deposit Capture (RDC), under certain circumstances. To assist financial institutions with the new RDC Duplicate Indemnity option and help streamline the claim process, we have developed this package including three fillable PDF forms. The first form is the Depositary Bank Request for Information Form to assist with requesting the information from the Paying Bank that is needed to file the indemnity claim. The second form is the actual Remote Deposit Capture Indemnity Claim Form to utilize when dealing directly with the RDC Bank. And, the last form is the Remote Deposit Capture Indemnity Disclaimer Form which can only be filed if your institution receives an indemnity claim but has already processed a return or an adjustment on the duplicate item.
